Well you cant say the guy in the car didn't try to get out of the way, he was in the trees. looking at the road in photo 14 this guy wasn't the first judging by the skid mark

You can pick the frame where he over shoots the corner and the sees the car, the next frame the bike is beginning to stand up. So instead of concentrating on his side of the road and riding there he panics and focues on the front of the car. As Pat said the car was half way in the trees, he should have made that easy.
