The Cop's tactics of 'entrapment' hasn't been defeated but rather a specific instance of erratic driving forced the riders to take evasive action on the grounds of safety. "The riders told the court they felt safer overtaking the undercover vehicle than following it as it veered across the lane."


"Magistrate Eve Wynhausen disagreed, describing their driving as ''erratic'' and said it had caused each of the riders to break the law.'"

I think the telling evidnce was "James said they had been on a casual ride when, ''in a flurry of dust and gravel'', a grey SUV pulled out in front of them,........"


"their barrister argued the police acted improperly and that any evidence against the riders was inadmissible."
I don't think the magistrate agreed with the barrister - the evidence wasn't thrown out, rather the magistrate said ''I am satisfied on the evidence that the driving had some influence on the actions of the defendants and that …"


It was probably a Section 10 - 'case proven no record entered'.

It good to see a win for the ordinary guy and the justice system working but as a rider you will still have to be aware of these police tactics particular on the popular Go Fast road close to the city. You can bet the cops have learnt from the loss and will come back with a more refined entrapment ploy.

The fact remains they still crossed solid white lines. I know one guy who was busted on that weekend, he has been booked before for the same thing so obviously a bit of an idiot. I wonder if the cop driving the SUV was booked for dangerous driving. Also there was an article somewhere just after the weekend in question where the highway patrol were questioned about using unmarked SUVs and they denied having ever used one.

You can see in the coppers video that the car is just above walking pace and the bike goes past at probably 60k's. Best fit a Go-Po before you ride up there.
